Terms and Conditions

Thank you for choosing LookSharp. These Terms and Conditions ("Terms") govern your use of the LookSharp mobile application and related services provided by LookSharp, a Ghanaian registered entity ("we", "our", or "us"). By accessing or using LookSharp ("the App"), you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

To use LookSharp, you must be at least 18 years old, legally capable of entering into binding contracts, and reside in a jurisdiction where LookSharp operates. You must complete a valid registration process, including Know Your Customer (KYC) checks, and accept these Terms and our Privacy Policy. You are also responsible for ensuring that the information you provide is accurate, complete, and current at all times.

2. Description of Services

LookSharp is a digital reward-based platform that allows users to participate in surveys and earn points in exchange for their feedback. These points can be converted to cash through mobile money platforms or used to redeem exclusive offers. The App provides brands with direct access to consumer insights and includes promotional content, referral bonuses, and limited-time offers from partner businesses.

3. Account Registration

In order to use the App, you must complete a registration process using your mobile number, verify your identity through SMS authentication, and submit relevant personal information, including demographic details and preferences. For withdrawal of earnings, you are required to complete a KYC process by providing a valid national ID and a selfie for verification purposes. You are responsible for keeping your login credentials confidential and must immediately notify us of any unauthorized use of your account. We reserve the right to suspend or terminate accounts with false, misleading, or incomplete information.

4. Accuracy of Information

While we strive to ensure that the information presented through the LookSharp App is accurate and up to date, there may occasionally be typographical errors, inaccuracies, or omissions that relate to promotional content, brand offers, reward details, survey descriptions, or other features. LookSharp reserves the right to correct any such errors, inaccuracies, or omissions and to change or update content at any time without prior notice, including after a user has engaged with a survey, viewed a brand offer, or initiated a reward redemption. Users acknowledge and accept that LookSharp does not guarantee the completeness or accuracy of all third-party content or promotional materials, and we are not responsible for any reliance placed on outdated or incorrect information presented within the App.

5. Use of Services

By using LookSharp, you agree not to engage in any fraudulent, illegal, or unauthorized activity. You must not interfere with the integrity or performance of the App, attempt unauthorized access to systems or networks connected to the App, or provide false information to manipulate the outcome of surveys or reward distribution. You are also prohibited from using the App to distribute any content that is offensive, misleading, defamatory, or infringing on the rights of others. Any violation of these provisions may result in the immediate suspension or termination of your account.

6. Surveys and Reward System

Surveys on LookSharp are dynamically matched to users based on their profiles, and the number of points awarded for completing a survey depends on its length, complexity, and specific targeting parameters. Survey responses are subject to validation measures such as attention checks and time tracking to ensure quality and authenticity. Points earned are non-transferable, non-refundable, and may expire if not redeemed within a specified period, which will be communicated in-app. We reserve the right to amend, suspend, or discontinue any aspect of the reward system at any time.

7. Payment and Payouts

Payments to users are facilitated through mobile money platforms and processed via Paystack's Transfer API. Before initiating a withdrawal, users must verify their identities and satisfy KYC requirements. Payouts are usually processed instantly, but LookSharp shall not be held liable for any delays or failures arising from mobile network issues, incomplete or inaccurate user information, or system downtime associated with third-party payment processors. Transaction history and payment receipts will be made available to users within the App.

8. Brand Offers and Exclusives

As a user, you may have access to limited-time promotions, discounts, and early product releases from our brand partners. These offers are tailored based on your profile and activity, and are governed by specific terms and conditions, such as availability and eligibility. While we facilitate access to these offers, we do not assume responsibility for the quality, safety, usability, or fulfillment of goods or services provided by third parties. Users are encouraged to evaluate offers carefully before redemption.

9. Privacy and Data Use

Your personal data is processed in accordance with our Privacy Policy, which outlines how we collect, store, use, and share your information. Data is collected for purposes including account verification, survey targeting, service customization, analytics, and reward processing. We implement security safeguards such as encryption, secure cloud storage, and access controls. Where necessary, anonymized survey responses may be shared with brand partners to improve market insights, but we do not sell your personal data.

10. Intellectual Property

All content and intellectual property available on or through the App, including logos, trademarks, software, design elements, and other proprietary materials, are owned by LookSharp or its partners and licensors. You are granted a limited, non-exclusive, non-transferable license to use the App solely for its intended purposes. You may not copy, reproduce, distribute, reverse-engineer, modify, or create derivative works from the App or any part thereof without our prior written consent. The LookSharp logo is a registered trademark of LookSharp in Ghana and other jurisdictions.

11. Communications

By creating an account, you agree to receive communications from LookSharp via email, SMS, and push notifications. These communications may include account updates, survey invitations, promotional content, and administrative notices. You may opt out of receiving promotional messages at any time by adjusting your notification settings within the App, but we reserve the right to send you transactional or legally required communications regardless of your preferences.

12. Disclaimer and Exclusions

The App and all associated services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, LookSharp excludes all representations and warranties relating to the App and its content, including any that may be implied by law or provided by affiliates or third parties. This includes, without limitation, warranties concerning accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

LookSharp and its technology providers, infrastructure vendors, analytics platforms, payment processors, and other service partners shall not be liable for any direct or indirect loss, including but not limited to loss of profits, revenue, data, or any other economic or commercial damages. To the extent permitted by law, the total cumulative liability of LookSharp for any claim under these Terms shall not exceed the total amount you have paid to LookSharp within the twelve-month period preceding the claim.

13. Limitation of Liability

To the fullest extent permitted by law, LookSharp shall not be liable to you for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses arising out of or relating to your use of the App or services, whether based in contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of such damages.

14. Indemnity

You agree to indemnify, defend, and hold harmless LookSharp, its affiliates, officers, employees, and partners from any claims, losses, liabilities, damages, expenses, or costs (including legal fees) arising from your use of the App, your violation of these Terms, your infringement of any third-party rights, or any misrepresentation or breach of warranty.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be resolved through arbitration conducted in accordance with the rules of the Ghana Arbitration Centre. The seat and place of arbitration shall be Accra, Ghana, and the arbitration shall be conducted in English.

Notwithstanding the foregoing, LookSharp may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

16. Referral and Incentives

LookSharp may offer referral programs or incentive schemes from time to time. Participation in such programs is subject to additional terms and conditions. We reserve the right to modify, suspend, or terminate any referral or incentive program at any time. Fraudulent or abusive conduct in connection with these programs may result in forfeiture of points, account suspension, or legal action.

17. Account Monitoring and Suspension

LookSharp reserves the right to monitor all accounts and activities on the App for compliance with these Terms. If we detect or suspect any fraudulent, abusive, or otherwise prohibited activity, we may, in our sole discretion, suspend or terminate your access to the App, withhold rewards, and take any legal or technical actions necessary to prevent further misconduct.

18. Third-Party Services and Integrations

The App may integrate or interoperate with third-party services such as mobile money platforms, analytics providers, and brand partners. LookSharp does not control and is not responsible for the availability, accuracy, or reliability of any third-party services. Use of third-party services may be subject to their separate terms and privacy policies.

19. Cookies and Tracking Technologies

LookSharp uses cookies and similar tracking technologies, including Firebase Analytics, to improve functionality, understand usage patterns, and provide a personalized user experience. By using the App, you consent to our use of these technologies as described in our Privacy Policy.

20. Modification of Terms

We reserve the right to update, revise, or modify these Terms at any time. Changes that are material will be communicated through email, app notification, or other reasonable means at least seven days prior to their effective date. Changes that relate to legal compliance or new service features may take effect immediately. Continued use of the App after any such changes constitutes your acceptance of the revised Terms. If you do not agree to any modified terms, you must discontinue use of the App.

21. Miscellaneous

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and LookSharp with respect to the Services and supersede all prior or contemporaneous communications and understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. You may not assign or transfer these Terms without LookSharp's prior written consent.
